Shopper claims Pick n Pay was negligent in her personal injury, threatens a lawsuit!

A disgruntled and now handicapped Mosa Tsoeu, who was heavily pregnant when she sustained an injury to her waist in Pick n Pay store, is now threatening to sue the large retail supermarket for ‘ditching her’.

According to Tsoeu, this month marks a year since her case has been thrown under the radar, after she visited the Pick n Pay store situated in Kroonstad, Free State on September 2021, where she was knocked off by a giant trolley and slipped and fell painfully on her waist.

Currently, the handicapped Tsoeu, who was fortunate to not have fallen on her belly which could have resulted in complications for her pregnancy, is now constrained and cannot do anything.

“I was at the shelves and checking products when an employee at the store knocked me down with a giant trolley, and lost my balance and fell to the ground,” says Tsoeu.

The 24-year-old says her matter was attended to, and escalated to the store manager who allegedly said the store will need to probe the incident.

However, to what came as a surprise to her, Tsoeu says in the accident report populated it was stated that there was no footage, and that the case stands no ground, citing there was no sufficient evidence to prove that it’s the store’s fault that she slipped.

Tsoeu says the store instead called the ambulance and she was then taken to a public hospital, Boitumelo Regional Hospital, which made no impact as she even had to dig in deeper into her pocket to go to a private surgery for medical attention and treatment, as she couldn’t bear the pain any longer.

After she came from the surgery, she had engagements with the store manager until she gave birth.

She says at that time of her injury, she was ten days before giving birth and the incident colluded with her time of giving birth, that resulted in overlapping of her period for birth due to injuries she sustained.

Prior to giving birth, she says she had constant communication with the store manager, named Kelebogile, and their tête-à-tête, broke down after she gave birth.

Tsoeu alluded that the manager would have frequent communication to check with her injuries and pregnancy, however, as soon as she heard that she was slowly recovering and had given birth Kelebogile ditched away.

“It is amazing that shortly after I gave birth, no one would check up with me anymore, and to my surprise this came at the time where I realised that I was not healed,” says Tsoeu.

She says she would text the store manager and tell her of the deteriorating medical condition, but instead she was snubbed.

Detailing it further, Tsoeu says Kelebogile alleged that the case is no longer in their hands and she must expect communication from the head quarters in relation to the claims, as she used her own money to treat her severe injuries.

Her last communication with Kelebogile, it was when she [the manager] told her [the victim] that she will call the head office as they promised to call and never reached out to her.

After a while, she received a call from a senior claims consultant who promised to assist her with the case, but in spite of that, they abandoned her matter although she came with a medical report that she was assisted at the medical centre.

The victim was billed R677 at the medical centre, but the invoice was not issued, Kasi Voice News, established that the retail store hold on to the absence of the invoice to not pursue with the case.

With emails seen by Kasi Voice News, the claims consultant alleged that she couldn’t help the victim as there are no sufficient documents despite the provided medical report to quantify the claim.

Tsoeu, who is currently unemployed, says her doctor told her that he could only assist her with pain medication and that she would need to consult a specialist, as her injury is severe.

She says her life is no longer the same anymore, and she is disgruntled that Pick n Pay has failed to compensate her for injuries she sustained at their facility, moreover, they also failing to settle her medical treatment fee.

“That’s how I live and at this point I am stuck at home… I’m not working and everything is at a standstill,” said emotional Tsoeu.

At the time of publication, Kasi Voice News reached out to the store manager, and the Pick n Pay headquarters with no availability.
